Its was i guess a compatibility error
but i fixed nowthat's awesome,what exactly did you do to fix it? as it may help others

right buttom click on the game> properties > compatibility > run this program .... (and i set it to windows7)

Nice glad you guys figured it out I am not sure why it automatically sets Windows Vista as compatibility Vista was always bad for games lol.
